SMS Program Overview

Program name: CDO Notifications

Operated by: Innovative Platform Solutions, Inc. (Nevada Business Identification No. NV20253289204), the owner and operator of the CDO platform.

Sent on behalf of: the company that uses CDO and with which you have a relationship, as your employer or as a customer.

Messages to workers

If your employer uses CDO, you may receive messages about your work, including:

• work schedule updates and changes;
• time-clock reminders, such as clock-in, clock-out and break reminders;
• job assignments and dispatch notices; and
• operational and safety alerts.

You agree to receive these messages when you provide your mobile number to your employer for work communications and your employer enrolls you in CDO. Receiving text messages is not a condition of employment, and you may withdraw your consent at any time as described in Opting Out.

Messages to customers

If you are a customer of a company that uses CDO, you may receive messages from that company about your jobs and appointments, estimates, invoices, payments and amounts due. You agree to receive these messages when you provide your mobile number to the company in connection with its services. Receiving text messages is not a condition of purchasing any service, and you may withdraw your consent at any time as described in Opting Out.

All messages under this program are informational. No marketing messages are sent through this program.

Who Sends the Messages

Messages are sent on behalf of the company that uses CDO from a number operated for the CDO platform. Replies sent to that number are received by the platform and the company.

The company may also exchange messages with you from its own phone line connected to CDO, and those messages are recorded in the platform as described in the Privacy Policy. These terms apply to any text message sent or received through CDO, whatever messaging service carries it.

Message Frequency

Message frequency varies. For workers, it depends on work schedules, assignments and operational needs, and you may receive several messages a day during active work periods. For customers, it depends on the jobs, appointments, estimates and invoices you have with the company.

Costs & Charges

Innovative Platform Solutions, Inc. is not responsible for charges from your mobile carrier.

Opting Out

You may opt out at any time, free of charge.

For workers, opting out does not affect your employment, pay, schedule or access to CDO; you will continue to see notices in the field app and the web portal. For customers, opting out does not affect your services; the company may continue to contact you by other means, such as email.

To receive messages again, reply START (or ALTA).

Privacy

Phone numbers and messages are used only to provide the communications described in these terms and the services of the company that uses CDO. We do not sell phone numbers or share them with third parties for marketing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. For more information, see our Privacy Policy.

Acceptable Use

If you use the CDO platform, you agree to:

• use it only for authorized, work-related purposes;
• keep your sign-in credentials and PIN confidential;
• provide accurate information, including in time and attendance records;
• not attempt to bypass or interfere with the platform's security; and
• report any unauthorized access or security concern to your supervisor.

A violation of these terms may result in suspension of access to the platform and in action under your employer's policies.

Limitation of Liability

The warranties, disclaimers and limitation of liability in the Terms of Service apply to this program. Text messages are delivered through mobile carriers and other messaging services that we do not control. We do not guarantee that a message will be delivered, or delivered on time, and text messages must not be relied on as the only means of communicating something urgent. Mobile carriers are not liable for delayed or undelivered messages.

Governing Law

These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law principles, on the same terms as the Terms of Service.

This does not affect any right you have under the law of the state where you live or work, including California employment, wage-and-hour and privacy law, or any protection that cannot be waived by agreement, including your rights under federal law regarding text messages.
